Recruiter Terms & Conditions

1. General

These additional Recruiter Terms and Conditions are in addition to the JobMagpie General Terms and Conditions (here) for use of the site and apply to all clients and recruiters, and are deemed as accepted for any service used by the client.

You, as the client, agree that all of the information you supply to us is correct, truthful and complete. You agree to inform us by email, telephone or post of any changes to any of the information supplied by you to us.

We reserve the right to terminate your use of the site in the event that any of the information provided by you to us, is no longer current or accurate or in the event you are in breach of these Terms & Conditions.

The term recruiter applies to clients, users, and account administrators.

2. Effective date

The effective date of the policy is 21/08/2016.

We reserve the right to amend this policy. If we make any minor changes to this privacy policy, we will post the revised Terms and Conditions here with an updated effective date.

Major amendments will be notified to clients by other means such as sending an email or posting a notice on our home page.

4. Jobseeker data accuracy

We will take reasonable steps to provide a reliable service to you. However, we cannot guarantee the accuracy or authenticity of any of the CVs stored in our database. In accepting these terms and using the site you acknowledge and accept that this is beyond our control, and refunds cannot be given in the event of untruthful information being submitted by jobseekers.

5. Data Protection / Confidentiality

In addition to our data protection principals you also acknowledge and accept that all rights to information provided by third parties or jobseekers are reserved by those third parties, and that such information may not be used in any way that infringes any proprietary interests of those third parties. You also agree not to disclose any information provided by the jobseekers to any third parties, or those not directly related to the recruitment process of the individual(s) in question.

All information provided to you by us is confidential you will not disclose your usernames and/or passwords to any persons outside of your company.

If disclosure occurs, we reserve the right to terminate this agreement immediately and seek compensation. Passwords are for the sole use of the person to whom they are issued. Passwords must be kept confidential and secure.

We may deny access to a password if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these terms and conditions.

You shall notify us as soon as reasonably possible in the event that you believe that your password has been compromised.

Upon notification of such an event, we will reset the password, and will issue a new password by email.

Job Magpie shall not be liable for any losses, damages or claims which result directly or indirectly from any person obtaining any passwords that we have issued you.

6. Intellectual Property Rights / Trade Marks

The Recruiter acknowledges that all intellectual property rights in the Services, technology supporting the Services (including the Upload System) and the JobMagpie site including the Company and/or its licensors and partners and that the Recruiter has no rights in, or to, such intellectual property other than the right to use in accordance with the Contract.

The Company has registered Trade Marks and Recruiters shall not use these marks without express permission.

7. Service Usage

Reselling of our services to other recruitment agencies or flat fee companies, or other companies or agencies for the purpose of recruitment is not allowed on the site without prior written permission from Job Magpie.

We reserve the right to suspend or close your account without notice if this occurs, cancelation will be without refund.

In addition, clients are also bound by the following:

  1. You cannot resell to direct clients of Job Magpie or hinder / stop companies from using our service.
  2. All postings must be in your own brand unless you purchase client branded adverts.
  3. The advert cannot name the name of the client unless client branded adverts have been purchased.
  4. We have the right to refuse to display any client branded adverts if we have a relationship with the client directly, or are in talks to do so.

Downloading or stripping our CV database, wholly or in part, for any reason other than recruiting for a current vacancy is strictly forbidden and will result in immediate cancellation of your account, without refund. (see fair usage details).

Downloading using any software other than a browser is also strictly forbidden and will result in immediate cancellation of your account, without refund. Legal action may be taken against you.

Our databases are protected against suspicious behaviour and details of the IP addresses accounts, user details etc. are constantly tracked and monitored for such behaviours.

Contacting jobseekers via email or other means, for any reason other than recruitment, is strictly forbidden. For example, marketing, sales, surveys etc.

You agree not to put excessive load on our servers or attempt to produce a denial of service.

Users must only access the Site(s) from systems that have the most up-to-date level of anti-virus software provided by a reputable manufacturer installed and running, should Malware or Viruses be detected via your user accounts we retain the right to suspend your account to protect our systems.

With regards to fixed users, you agree that user accounts will not be shared and only users within your company will have access to the account. If any unauthorized users attempt to access the account, or if the account is accessed from other locations, we reserve the right to cancel your account immediately, without refund.

You agree to deal fairly and professionally with jobseekers and individuals who may respond to an advertisement you have posted and not do anything which may bring the site into disrepute. You will indemnify us from and against any claim (including but not limited to, costs, damages, losses, expenses, liabilities) brought by an individual against Job Magpie arising from any breach of these obligations or any other of these terms and conditions by you (or your users) as the client.

Whilst we make every effort to promote your job postings within the site, we do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised.

It is your responsibility to make sure that the advert that you post is clear and accurate in such a way as to be clear as to the suitability of jobseekers.

It is also your responsibility to carry out all checks that you deem necessary to verify the legitimacy of the information supplied by the jobseeker, their competency level and to ensure that jobseekers are suitable for the job advertised and have the required valid qualifications and personal characteristics.

8. Posting Rules

We have rules regarding the content and format of jobs posted on Job Magpie.

The purpose of these rules is to ensure that jobseekers who search the site get results which are a match for the specific search criteria that they are looking for, and to ensure the results are presented in a clear and informative fashion.

You agree that we may remove from the site any advertisement which is posted in breach of these rules, at our discretion and without liability to you. The rules may change from time to time and you are advised to refer to them prior to posting a job advertisement.

Posting rules:

  • The job posted must exist in the location(s) advertised.
  • The job title should be specific and be the best description for the role. It must not include locations or salaries and should not be a slogan.
  • Job postings shall be accurate, truthful, and honest.
  • Emails, hyperlinks and URLs within job descriptions are not allowed.
  • The description of the role should mention the required skills as well as details describing the role. Contact names should not be mentioned in the job description.
  • If the job role offers training and there is a charge for this, then the vacancy must state the full details.
  • The vacancy should accurately describe the role and not mislead the jobseeker; sufficient detail should be included in order for the jobseeker to understand the nature of the role and the basic requirements of the role.

  • If a role requires a jobseeker to work in multiple locations then the vacancy must state this.
  • If the role is selling a product/service 'door-to-door' then the vacancy must state this.
  • If the role is a commission only role then this must be stated on the vacancy.
  • Advertisements which discriminate (or appear to discriminate) on grounds of sex, race, age or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher. Advertisements are accepted by Job Magpie on the basis that the advertiser confirms that any requirement or qualification which may appear to discriminate illegally is in compliance with any exemption available under the relevant legislation.
  • Jobs with deferred pay positions may not be posted.
  • Multi-level Marketing (MLM) jobs or positions that require a monetary investment from the jobseeker are not allowed.
  • Jobs promoting illegal activities.
  • Job offers for sex workers and erotic services.
  • Get rich quick adverts are not allowed.
  • Postings for Pyramid schemes are not allowed.

Job Magpie has a system for jobseekers to report any breach of these rules or any posting that they feel is not suitable or misleading. All reported cases are investigated and any found in breach will be removed without refund.

Your job posting(s) may be distributed to across our network of international or selected partner sites. However, we make no guarantee of this service. And we retain the right to either distribute or not according to the agreements we have in place at the time of posting. The fees paid are for the posing on JobMagpie only and any distribution amongst our network is at our discretion.

9. Payment Terms

All job posting shall be paid in advance by crediting your account with the necessary funds.

  • Payment may be made online by credit or debit card, payments made by cheque or bank transfer or direct debit will be allocated to your account upon receipt of cleared funds.
  • Prices are determined by the site and can be paid for online.
  • You agree that we may alter the above rates within 28 days of notifying you of such changes.
  • All prices include Tax where applicable.

Job credits / advance funds do not expire.

Refunds cannot be provided if the jobseeker is not of the desired age, sex, race, or nationality, as these criteria contradict our equal opportunities policy, and common decency.

Refunds cannot be provided for any posting not obtaining applications.

Neither party shall be liable for any delay or non-performance under the Contract caused by any event beyond its reasonable control (i.e. a “Force Majeure Event”) provided that the party affected gives prompt notice in writing to the other party of such Force Majeure Event and uses all reasonable endeavours to continue to perform its obligations under the Contract. If the Force Majeure Event continues for more than one month, the party not subject to the Force Majeure Event may terminate the Contract by notice in writing to the other party.

10. Fair Usage

Jobseeker CV downloads, CV searches and CV watchdogs are subject to a fair usage policy.

Job Magpie deem fair usage to be 300 CV searches and 300 CV downloads or 300 CVs received per CV watchdog per company account per day where.

A user is a person, company or firm who is named as the Recruiter in client account.

A day is considered a calendar day between the hours of 00:00:00 GMT and 23:59:59 GMT..

Job Magpie reserves the right to amend any fair usage limits that have been imposed without prior notification to users. Additional access may be agreed to companies with significant user accounts.

11. Jurisdiction

These General Terms are governed by English law. The English courts shall have exclusive jurisdiction over any claim brought by you arising from, or related to, use of the Site and Services and these General Terms.

You should note however that it is possible that some of the services offered through the Website and links, may not be lawful or may otherwise not be permitted in certain countries outside the United Kingdom. If you attempt to use, receive, purchase or otherwise benefit from any such goods or services, we do not accept any liability for any losses suffered by you (including as a result of us being prevented from dealing with any application or enquiry by any law, regulation or other ruling applicable in any country).

In addition to the general terms and conditions for recruiters and as part of our ongoing commitment to operating securely we have selected WorldPay to manage the processing of payments through our website.
